Two Granite City residents say their insurance company refuses to pay for their stolen vehicle.
Adrian Will and Maria Yourglass filed a lawsuit Dec. 3 in Madison County Circuit Court against Progressive Northern Insurance Company and Marcus Rapp.
The night of May 19, 2012, through May 13, 2012, the plaintiffs’ automobile was stolen, according to the complaint. Following the incident, Will and Yourglass attempted to collect money from Progressive under their insurance policy, but have not been reimbursed, the suit states.
In their complaint, Will and Yourglass claim their Progressive policy was supposed to pay for their vehicle if it was stolen.
Will and Yourglass say Progressive failed to investigate their claim in a timely manner, refused to pay losses and refused to even communicate with Will and Yourglass regarding their claim, the complaint says.
Will and Yourglass allege Progressive breached its fiduciary duty, engaged in fraud and breached its contract with them.
In their complaint, Will and Yourglass are seeking a judgment of more than $150,000, plus pre-judgment interest, attorneys’ fees and punitive damages of $400,000.
