Driver accused of causing collision while intoxicated

A Belleville resident claims a motorist was intoxicated when he allegedly caused a collision, resulting in injuries.

Ryan R. Maitland filed a lawsuit on June 16 in St. Clair County Circuit Court against Harlan H. Ferry III, claiming vehicular negligence in a June 2013 collision.

According to the complaint, Maitland was driving eastbound on Lake Forest Drive in Belleville on or about June 19, 2013. The suit states that Ferry entered the plaintiff’s lane while traveling westbound and collided with his vehicle violently.

The suit states that Ferry was in breach of care by neglecting to keep a proper lookout; that he drove his automobile too fast; and failed to reduce speed, brake and control his vehicle. The charges include driving while intoxicated in violation of the law, and the complaint states that the defendant plead guilty to DWI.

As a result of the defendant’s purported acts or omissions, the plaintiff claims temporary and permanent injuries to his head, neck and back. Alleging pain, anguish, medical expenses, and hindrance from attending to his usual duties and affairs, Maitland seeks judgment in his favor for damages in excess of $50,000 plus attorneys’ fees and costs.

He is represented by Brian Flynn of Flynn Guymon & Garavalia in Belleville.
