Woman in wheelchair claims she was injured in collision with motorist

A disabled woman claims she was injured when a driver collided with her motorized wheelchair

Anna Pitts filed a lawsuit on May 27 in St. Clair County Circuit Court against Rebecca Chester, of East Alton, VNA Homecare Inc., VNA-TIP Homecare Inc. and Celtic Healthcare of Southern Illinois, alleging negligence.

According to the complaint, on July 18, 2013, Pitts was using her wheelchair at the Crown Food Mart in Centreville when Chester failed to keep a proper lookout for others in the area and struck Pitts with her vehicle.

The suit says Chester failed to properly control her vehicle, drive at an appropriate speed as to have enough time to stop her vehicle and avoid colliding with the plaintiff, and applying her brakes in a timely manner.

Pitts is also suing the companies where Chester was an employee and/or authorized representative.

The plaintiff alleges she suffered severe and permanent injures causing disability and disfigurement, which has led to great physical pain, mental anguish and the ability to enjoy a normal life.

Pitts seeks damages in excess of $50,000, plus costs of the lawsuit.

She is represented by attorney Jeffrey Kopis of Kopis Law Office in Fairview Heights.

St. Clair County Circuit Court case number 2015-L-315.
