A Madison County motorist is suing another driver, alleging negligence in a highway crash.
Patrick Bailey filed a lawsuit on June 9 in Madison County Circuit Court against Charles Patton of Cottage Hills, seeking damages in a 2013 motor vehicle collision.
According to the filing, on June 11 ,2013, Bailey was driving on state Route 3 in Granite City near the intersection of Interstate Highway 270 when Patton merged his vehicle into the plaintiff’s vehicle on the passenger side, causing property damage and personal injury.
The suit states the defendant had a duty to operate his vehicle with due care. It alleges he was negligent in failing to keep a careful lookout, yield the right of way, pay sufficient attention to his surroundings including the plaintiff’s vehicle, and heed traffic conditions by lowering his speed, swerving or sounding a warning to avoid the collision.
The plaintiff alleges severe and disabling injuries, medical bills, pain and suffering.
Bailey seeks damages in excess of $50,000 to be determined by the court, plus attorney fees and costs.
