Passenger claims driver failed to yield the right of way

A Madison County woman is suing a motorist, alleging vehicular negligence in an automobile accident.

Sherry L. Zook of Moro filed a lawsuit June 4 in St. Clair County Circuit Court against David E. Grace Jr., also of Moro, alleging personal injuries in a 2014 motor vehicle accident.

According to the complaint, on Aug, 2, 2014, Zook was a passenger traveling in a 2013 Jeep Wrangler driven by her husband, Earl E. Zook II, heading westbound on state Route 140 near the intersection with South Moreland Road in Bethalto and the defendant was operating a 2000 Oldsmobile Alero GI eastbound on 140. The suit says when Grace attempted to turn north onto South Moreland, he failed to yield the right of way and crashed into the vehicle in which the Zooks were traveling.

The defendant is faulted with: failing to keep a proper lookout for other vehicles; control his vehicle; and drive at an appropriate speed for the circumstances so as not to endanger others’ safety. The suit alleges Grace was negligent in failing to use precautions, obey a traffic sign and decrease his speed in order to avoid the collision.

The plaintiff cites personal and pecuniary injuries, including neck, shoulder and back injury, as well as medical expenses.

Sherry Zook seeks for damages in excess of $50,000, plus attorney fees and costs. She is represented by attorney Keith Short of The Law Offices of Keith Short in Edwardsville.
