Man alleges driver intoxicated in rear-end collision

A St. Clair County resident claims he was hit by a drunk driver in a rear-end collision.

Nicholas Armstrong filed a lawsuit on June 4 in St. Clair County Circuit Court against Cynthia Tanner, alleging she rear-ended his car at a high rate of speed when she was driving while intoxicated.

According to the filing, the plaintiff was operating his motor vehicle on St. Clair Avenue at its intersection with Collinsville Avenue in East St. Louis on June 8, 2013.

The suit states that the defendant was also operating her motor vehicle on St. Clair Avenue when she allegedly failed to stop at a stop sign, consequently rear-ending the plaintiff’s vehicle at an excessive speed.

The plaintiff claims the defendant is responsible for negligence, alleging that her reckless driving was the proximate cause of property damage and personal injuries.

Armstrong claims he lost consciousness, and received injuries to his head, neck, scalp, ear, back, leg, hips and nerves. He requests compensation for medical expenses, disability, pain and suffering, along with loss of enjoyment of life, and lost wages and earning potential.

The plaintiff seeks damages in excess of $50,000, plus attorneys’ fees and costs.

Armstrong is represented by Michael McGlynn of McGlynn & McGlynn in Belleville.
