Recycling company accused of failing to share proceeds from scrap metal

A St. Clair County zinc corporation claims an Ohio-based recycling business and its owner failed to share proceeds from scrap metal.

Big River Zinc Corporation filed a lawsuit on May 27 in St. Clair County Circuit Court against General Recovery Recycling (GRR) LLC, doing business in Illinois, and Johnny G. Wanko of Galena, of Ohio, claiming contract infringement.

According to the complaint, the parties entered into a written contract on Feb. 16, 2015, by which the defendant agreed to remove and recycle zinc from property owned by the plaintiff at 2401 Mississippi Ave. in Sauget. The defendants allegedly agreed to sell the scrap zinc at the highest available price and split the proceeds with the plaintiff, separately from the costs of removal.

The plaintiff asserts that GRR failed to fulfill the contract, alleging that it neglected to share the sale proceeds or pay $60,000 for electric motors removed from the plaintiff’s premises, the suit states.

Alleging breach of contract and unjust enrichment, Big River Zinc seeks compensatory damages in excess of $50,000, plus attorneys’ fees and costs, and other further relief deemed appropriate by the court.
