Driver alleges negligence in highway collision

A St. Clair County motorist is suing another diver for allegedly causing a highway collision.

Kurt A. Stellhorn filed a lawsuit on May 28 in St. Clair County Circuit Court against Darnaizha L. Wallace, alleging damages in a 2013 accident.

According to the complaint, on June 21, 2013, Stellhorn was driving his 2005 Ford F Series pickup truck southbound in the center lane of Interstate Highway 255 in Centreville Township, when Wallace allegedly collided with Stellhorn’s vehicle in the right lane while operating a 1999 Toyota Avalon.

The suit states Wallace failed to operate her vehicle safely; give audible warning of her approach; drive at an appropriate speed; control her car, brake and stop to avoid collision; and keep a proper lookout for others.

The plaintiff alleges serious personal injuries, pain and anguish, and past and future lost wages. The suit says he has been prevented from attending to his usual affairs and occupation, and has incurred medical expenses.

Stellhorn seeks damages in excess of $50,000, attorney fees and costs, and any further relief deemed appropriate by the court.

He is represented by attorney Anthony Gilbreth of Crowder & Scoggins in Columbia.
