Trucker alleges wrongful discharge

A trucker is suing his former employer, alleging wrongful termination.

Phillip Lusch filed a lawsuit on April 20 in St. Clair County Circuit Court against ABF Freight Systems, alleging unlawful termination.

According to the complaint, on Sept. 5, 2014, Lusch was employed by ABF Freight as a truck driver and sustained injuries during the scope of his work duties. The suit states that after Lusch received treatment, he informed his employer of the work-related injury and was terminated on Sept. 10, 2014.

The plaintiff alleges his discharge was a violation of employment law and public policy and in retaliation for the plaintiff’s filing for worker’s compensation benefits.

The suit states that the defendant’s actions are consistent with a pattern and practice of violating its employees’ rights. The plaintiff also alleges ABF Freight Systems' actions were willful, malicious and oppressive in nature, warranting punitive damages.

Lusch alleges substantial wage losses and retaliatory actions.

Lusch seeks damages in excess of $50,000, plus attorney fees and costs. He is represented by attorney Christopher Daniels of Daniels Law Firm in Salem.
