A woman filed a Dram Shop suit against a tavern, its owner and a patron, claiming she was stabbed and beaten during a fight in the tavern.
Tonya Dailey filed a lawsuit on May 22 in Madison County Circuit Court against Alexis Arosemena, d/b/a Nick’s Bar and Grill, and Erika Hartwick, alleging negligence.
According to the complaint, Dailey was in the tavern at 3900 Nameoki Road in Granite City on or about Dec. 19, 2014, when an intoxicated group of individuals initiated a fight, allegedly beating, striking and stabbing her unprovoked and without warning.
The plaintiff claims Hartwick assaulted her as a result of being overserved alcoholic beverages. Hartwick is accused of intentional infliction of harm. Dailey claims she was viciously attacked.
The plaintiff also alleges the bar breached its ordinary care of duty for her safety, failed to protect its patrons and warn them of danger and allowed the premises to become dangerous. Additionally, the plaintiff claims previous alleged incidents at the location.
Dailey alleges pain, suffering and mental anguish, medical expenses and lost earning capacity.
She seeks damages in excess of $50,000, plus attorneys’ fees and costs. Dailey is represented by Morgan Scroggins of Scroggins Law Office in Granite City.
