Patient claims back surgery left her with spine, nerve injuries

A patient at St. Elizabeth's Hospital claims she suffered back injuries resulting from a botched surgical procedure.

Z. Marlene DeWeese filed a lawsuit on May 22 in St. Clair County Circuit Court against Joseph Yazdi, alleging negligence.

According to the complaint, the plaintiff presented to the defendant for the purpose of evaluation and treatment of a spine condition on Feb. 23, 2012, at St. Elizabeth’s Hospital in Belleville. The suit states that when the doctor performed a surgical procedure, the plaintiff sustained injury to her spinal cord and/or adjacent nerves and tissues.

The plaintiff asserts that injury would not have occurred had the defendant exercised a reasonable standard of care during the process.

DeWeese claims she experienced and will continue to experience pain, suffering, loss of a normal life and medical expenses. She also claims she became disabled as a result of the incident.

The plaintiff notes a previous suit involving the same parties filed on Feb. 21, 2014, and allegedly dismissed on May 23, 2014.

The plaintiff seeks damages in excess of $50,000, plus attorney’s fees and costs. She is represented by Michael J. Meyer of Effingham
