Red Bud hospital sued after toddler died following alleged misdiagnosis

BELLEVILLE — Red Bud Regional Hospital is being sued by the family of a toddler who died after he was misdiagnosed and discharged from the hospital.

Rachel Budko, as Special Administrator of the Estate of Ozzy Embrich, deceased, filed a complaint on Oct. 31 in the St. Clair Circuit Court against Dr. Anthony Truong and Red Bud Regional Hospital, also known as Deaconess Illinois Rural Health Clinic Red Bud, alleging medical negligence.

According to the plaintiff's complaint, Ozzy Embrich, who was 21 months old, was brought to Red Bud Regional Hospital's emergency department on Nov. 28, 2022. Budko claims her child was suffering from Systemic Inflammatory Response Syndrome and possible sepsis. However, Embrich was prescribed Tamiflu and then discharged. The plaintiff claims that the next morning, Emrich was found non-responsive and pronounced dead on the morning of Nov 29, 2022. 

Budko alleges the defendants failed to adequately diagnose Embrich's condition and failed to read his positive SIRS test result. The plaintiff also alleges the defendants failed to order the necessary tests or X-rays, failed to adequately treat Embrich and failed to refer him for examination by a pediatrician.  

The plaintiff seeks monetary relief of more than $50,000, plus interest, trial by jury and all other just relief and is represented by Bruce Cook of Cook, Bartholomew, Shevlin, Cook & Jones LLP in Belleville.
