Wrongful death suit alleges nursing home patient suffered brain injury from fall

EDWARDSVILLE — A family member of a nursing home patient who died after suffering a traumatic brain injury claims the patient fell as a result of negligent care.

Andrew Hruby, as special representative of the estate and special administrator of Leslie M. Hruby, deceased, filed a complaint on Nov. 13 in Madison County Circuit Court against Alton NH LLC, doing business as River Crossing of Alton, alleging wrongful death and other claims.

According to the plaintiff's complaint, Leslie Hruby was a resident of the defendant's facility from Oct. 29, 2021, through Dec. 28, 2021. She was admitted there following a stroke and was a significant fall risk. The plaintiff claims that despite being assessed by the facility as a fall risk, Leslie Hruby was found on the floor of her room after falling. She had suffered a traumatic and severe head injury due to a "violent fall." 

The plaintiff claims Leslie Hruby was transferred to a hospital, where she was diagnosed with another injury, an acute intraparenchymal hemorrhage of the brain. According to the complaint, Hruby died on Dec. 28, 2021, from a "cerebral vascular accident" while at a hospital for neurological care.

The plaintiff seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. He is represented by Craig Jensen and Brian Burge of MeyerJensen PC in Alton.
