BELLEVILLE — A suspended Belleville attorney is being sued by another former client for allegedly keeping funds from her settlement following a car crash.
Heidi Davis filed a complaint in St. Clair County Circuit Court against Caraway, Fisher & Broombaugh PC, Jason Caraway, Cheryl Fisher and Daniel Broombaugh alleging breach of fiduciary duty and other claims.
According to Davis' complaint, she was involved in an automobile collision on May 2, 2016. She claims she suffered serious personal injuries and incurred medical expenses of $41,726.71. Davis allegedly retained Caraway to handle her personal injury case.
Davis claims that on Sept. 27, 2017, defendant Caraway negotiated a $100,000 settlement for her case, which was deposited in the CFB IOLTA Client Trust Fund. Davis alleges she only received $25,728.32 of the settlement. She adds that after the defendants took their fees, at least $41,726.71 should have been left over in the trust account.
She alleges the defendants falsely claimed they were holding the remaining funds to negotiate and pay her medical expenses and liens. However, they allegedly failed to pay all her medical expenses, which resulted in a collection notice from one of her medical service providers. Davis claims the defendants improperly removed money from the trust account.
Davis seeks monetary relief of more than $50,000, plus interest, trial by jury and all other just relief. She is represented by attorney Mark Prince.
