Suit alleges Geodis violated Illinois privacy law

EDWARDSVILLE — Geodis is being sued by employees for allegedly violating the Genetic Information Privacy Act.

Steven Newbern, individually and on behalf of similarly situated individuals, filed a complaint in Madison County Circuit Court against Geodis Logistics LLC, and others, alleging violation of the Illinois Genetic Information Privacy Act.

Newbern alleges in his complaint that he applied for a job with the defendants in February 2023 and was hired as a forklift operator. He claims he was required to submit to a physical exam as part of the hiring process, which included questions relating to his family members and health history. Newbern alleges that he disclosed his genetic information, including diseases and disorders. 

Newbern claims Geodis violated Illinois law by requiring him to answer questions about his family medical history and requiring the disclosure of his genetic information. He further claims he and the class members were not advised either verbally or in writing of their protected rights not to have to provide family medical history of genetic information. 

Newbern and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Timothy Kingsbury, Andrew Heldut and Joseph Dunklin of McGuire Lw PC in Chicago.
