BELLEVILLE — After a St. Clair County jury returned a defense verdict following a car crash, the plaintiff is asking the court to adjudicate the claimed lien.
Brooke Martin, the plaintiff, filed the motion to adjudicate on Sept. 27 in St. Clair County Circuit Court, seeking to adjudicate the claimed lien/claims of subrogation.
Martin claims she incurred a total of $22,041.20 in medical charges. She claims the available insurance is inadequate for the damages sustained and that her damages are substantial and ongoing.
A hearing was held on Oct. 24 at the St. Clair County Courthouse.
Previously, Susan Spalding, the defendant, had filed a motion to reconsider the court's ruling on the plaintiff's motion in limine.
Martin filed a motion in Limine seeking to bar any reference to the former defendant, Brandon Riegel, and his actions. Spalding argued that there was ample evidence within the deposition transcripts that Riegel caused the collision that caused Martin's injuries.
On Sept. 7, the court granted the motion in part. Spalding argues the ruling severely harms her defense.
The case was a personal injury claim seeking damages for a crash that happened on June 6, 2022, involving Martin and Spalding. Spalding denied she was negligent in causing the collision.
