EDWARDSVILLE – A wrongful death suit alleges a patient at Anderson Hospital died of a heart attack because medical professionals allegedly failed to provide timely care even though tests showed signs of his condition.
Plaintiff Kathleen Wylie, acting as independent administrator of the estate of James S. Wylie, filed a wrongful death lawsuit in the Madison County Circuit Court against Anderson Hospital, Inc., Midwest Emergency Anderson Health Inc., Ignacio Salas, MD, Anderson Medical Group, LLC, Fairview Heights Medical Group, S.C., doing business as BJC Medical Group, Midwest Inpatient Anderson Health Inc., and Mahmud Al Furgani, MD, citing negligence and recklessness in violation of the Illinois Nursing Home Act.
According to the lawsuit, James Wylie arrived at Anderson Hospital at approximately 7 p.m. on Dec. 1, 2022, complaining of chest pain. An EKG showed that he was suffering from a heart attack. Following preliminary tests, Jams was admitted to the hospital ICU at approximately 9 p.m. The lawsuit alleges that at approximately 9:09, an echo Doppler color flow for James' heart was ordered, but it was never performed. Then around 9:10 p.m., another EKG was performed, which again showed that James was suffering from a heart attack.
At around 9:49 p.m., Salas and a cardiologist of the hospital collectively determined that there was no need for percutaneous coronary intervention, a procedure used to open clogged heart arteries, at the time. The lawsuit states that at approximately 11:30 p.m., critical tests showed abnormalities. This test was completed again approximately 5 hours later at 4 a.m. the following day, which again showed abnormalities.
According to the lawsuit, no physician was notified of the results of these tests until 8 a.m. on Dec. 2. At around 8:20, a nurse witnessed the readings on James' heart monitor and called a code blue. Despite attempts to revive him, James died from a heart attack at 8:51 a.m.
The lawsuit states that, through negligence, the defendants collectively failed to provide proper and timely care to diagnose, recognize, and treat James' heart attack and that he ultimately died as a result of the defendants' negligence and carelessness.
James' wife, Kathleen Wylie, is legally blind and suffers from cerebral palsy. She alleges that as a result of the defendants' negligence, not only has she lost her husband and has been deprived of his love, consortium, and support, she has also lost her caregiver and provider.
The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorneys Morgan C. Murphy, David M. Zevan and Rachel L. Roman of Zevan, Davis, Roman, LLC in St. Louis.
