Suit alleges Protestant Memorial Medical Center patient suffered head injury after fall

BELLEVILLE – A patient of the Protestant Memorial Medical Center in Belleville claims he was neglected under the facility's care, causing him to fall and suffer serious head and brain injuries. 

Plaintiffs James and Maureen Morris filed the lawsuit in the St. Clair County Circuit Court against Protestant Memorial Medical Center, Inc., doing business as Memorial Care Center, citing negligence in violation of the Illinois Nursing Home Care Act.

According to the lawsuit, James Morris was a long-term resident and patient under the care of the Protestant Memorial Medical Center in Belleville. The lawsuit states that on Aug. 27, 2021, James suffered a fall, which caused him traumatic brain injuries and nerve damage. 

The lawsuit claims the defendant negligently failed to provide proper care and treatment to James, failed to ensure his health and safety, and failed to safeguard him from falling. 

The lawsuit states that as James was admitted into the defendants' care, he was a protected individual under the state's Nursing Home Care Act.

As a result of the defendant's alleged negligence, James has experienced pain, suffering, disability, emotional distress and mental anguish. He adds that he has incurred medical expenses and will continue to require the services of medical staff to recover from his injuries. 

Maureen claims that as a result of the defendants' negligence, she has suffered the loss of her husband's support, companionship and consortium. 

The plaintiffs are seeking damages in excess of $50,000, plus attorneys' fees, court costs and any other relief the court deems proper. They are represented in this case by attorney Michael L. McGlynn of McGlynn & McGlynn in Belleville.
