Shopper allegedly struck by stocking buggy at Fairview Heights Bed Bath & Beyond

BELLEVILLE – A shopper is suing Bed Bath & Beyond after she was allegedly struck by a stocking buggy being driven by an employee while at a Fairview Heights store.

Plaintiff Carla Cox Smith filed the lawsuit in the St. Clair County Circuit Court against Bed Bath & Beyond, citing negligence.

According to the lawsuit, the plaintiff was a patron at a Bed Bath & Beyond store in Fairview Heights on May 12, 2022. She claims that while she was shopping, she was struck by a stocking buggy that was being driven by an employee. As a result, she claims she suffered serious injuries. 

The plaintiff alleges the defendants negligently failed to provide a safe environment to protect the safety of its customers, failed to keep a lookout for customers, and failed to properly provide warning about a potentially unsafe condition. 

The plaintiff alleges she sustained severe injuries, which required surgery. She also claims she has experienced pain, suffering, lost wages and alleges that her injuries will impact her ability to earn income and enjoy a normal life. She adds that she has incurred significant medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorney Ben Sansone of Sansone & Lauber in Clayton.
