EDWARDSVILLE – The owner of an East Alton property is suing American Family Mutual Insurance Company for allegedly refusing to honor an insurance claim after a tree fell on the plaintiff's house.
Plaintiff Btissam Hicks filed the lawsuit in the Madison County Circuit Court against American Family Mutual Insurance Company, citing breach of contract.
According to the lawsuit, Hicks owned a property located in East Alton. She claims she completed an application with American Family Mutual Insurance Company, which acted as an insurance broker to insure the property against damages.
Hicks states that on June 16, 2022, her property suffered considerable damage due to a fallen tree. In compliance with the terms of her policy, she reported the damage to American Family Mutual and requested coverage to repair the damages.
Hicks alleges the defendant denied the claim, breaching the agreement by failing to cover and pay for the insured damages and failing to provide reasonable claim adjustment services. Hicks adds that she has expended considerable amounts of money to repair the damages to the property. She also claims she expended funds in her attempts to persuade the defendant to uphold their end of the agreement and cover the damages.
The plaintiff is seeking damages in excess of $50,000, plus attorney's fees, interest, court costs and any other relief the court deems proper. She is represented in this case by the attorneys of Wendler and Zinzilieta, P.C. in Maryville.
