Woman sues Fresh Thyme over trip, fall in Fairview Heights

BELLEVILLE – A patron of the Fresh Thyme store in Fairview Heights has filed a negligence lawsuit claiming she tripped over a basket on the premises and suffered injuries. 

Plaintiff Joleen Hann filed the lawsuit in the St. Clair County Circuit Court against Lake Ventures, LLC, doing business as Fresh Thyme, citing negligence.

According to the lawsuit, the plaintiff was a patron at the Fresh Thyme store in Fairview Heights on Aug. 3, 2021. She claims that while she was shopping, she tripped over a loose basket that was on the floor and obscured by packs of soda that had been stacked on the floor.  

According to Hann, the defendants negligently failed to properly maintain the premises to protect the safety of its customers.

Hann alleges she suffered bodily injuries, which have caused her pain and suffering and will impact her ability to lead a normal life. She adds that she has incurred medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorney Jerry F. Costello of Bonifield & Rosenstengel, PC in Belleville.
