Madison County resident Paula Y. Walker is suing various construction companies, the City of Edwardsville and Madison County for negligence and premises liability.
According to the official court filing on March 15, 2022, the Edwardsville City Council awarded the 2nd Street and St. Louis Street Improvement Contract to Keller Construction, Inc., which subcontracted Stutz Excavating, Inc., and RCS Construction, Inc., to assist in the construction project.
On March 28, 2022, Edwardsville also approved a construction inspection and oversight contract to Volkert, Inc., and on April 22, 2022, the City approved professional service agreements with Oates Associates, Inc.
On July 8, 2022, Walker was allegedly returning from her lunch break and parked her car in the parking lot located directly across 2nd Street in Edwardsville.
Walker was walking toward her place of employment when a dump truck on 2nd Street allegedly drove in reverse toward her and caused her to fall and injure herself.
The court filing alleges that the various construction companies and municipal bodies involved in the construction project had a responsibility to provide reasonable care on-site and that they had failed her by committing various negligent acts including the following: failing to keep a proper lookout; failing to use every precaution to avoid a collision; failing to properly plan, create, and/or implement a pedestrian crosswalk to be used at the site before the incident; and failing to safely operate the site and its work zones so as to reduce and/or minimize the risk of hazards and/or injury to persons at the site.
As a result of the injuries caused by the incident, Walker has allegedly endured pain and suffering in the past and will continue to do so in the future. Walker also claimed to have lost wages and incurred other expenses as a result of the injuries.
The five involved construction companies are being sued for one count of negligence each, and both Edwardsville and Madison County are being sued for one count of premises liability each.
Walker is seeking judgment against each defendant for damages, costs, interests as allowed by law and other rewards that the court deems just.
