BELLEVILLE – A woman is suing the City of Fairview Heights, claiming that she was injured at the Recreation Complex due to a malfunctioning automatic door.
Plaintiff Joan Moss filed the lawsuit in the St. Clair County Circuit Court against The City of Fairview Heights, citing negligence.
According to the lawsuit, on June 21, 2022, Moss was exercising at the Rec Complex of Fairview Heights, a recreation facility operated and maintained by the City of Fairview Heights. Moss claims that while exiting the facility, she pressed the handicapped door opener button and the automatic doors opened allowing her to exit. The exit has two sets of automatic doors and Moss alleges she passed through the first set of doors and as she was passing through the second set, the doors suddenly swung shut, slamming into her and knocking her to the ground. As a result, she claims she suffered serious injuries.
Moss claims Fairview Heights negligently failed to maintain the doors properly, causing them to become defective and unsafe.
Moss states that as a result of the defendant's negligence, she has suffered lacerations and broken bones. She alleges her injuries have caused her to experience pain, suffering and disability, which will affect her ability to enjoy normal activities and earn income in the future. She adds that she has incurred medical expenses and will continue to require the services of medical staff to recover.
Moss is seeking damages in excess of $50,000 and any other relief the court deems proper. She is represented in this case by attorney Timothy C. Stubblefield in Fairview Heights.
