Man claims neighbor breached contract, knocked him unconscious during argument

BELLEVILLE – A man claims his neighbor breached a landscaping contract and then knocked him unconscious during a physical altercation. 

Plaintiff John C. Pyers filed the lawsuit in the St. Clair County Circuit Court against Michael L. Wilson and Wilson's Custom Retaining Walls.

According to the lawsuit, Pyers and Wilson are neighbors. They allegedly entered into an oral contract where Pyers agreed to pay $6,500 for landscaping work on his property. Pyers claims he paid in full, but Wilson allegedly failed to perform the work and failed to refund the plaintiff's money. 

"As a direct and proximate result of the aforesaid breach, plaintiff has been deprived of his funds and will be required to either perform the work himself or pay others to complete the work," the suit states.

Pyers adds that after the alleged breach of contract, he and Wilson got into a physical altercation on July 13, 2022, when Wilson allegedly punched Pyers in the head and knocked him unconscious. 

Pyers claims he sustained injuries, which have caused him to experience disfigurement and impaired vision. He adds that he has incurred medical expenses to treat his injuries.

The plaintiff is seeking damages in excess of $50,000, plus interest, court costs and any other relief the court deems proper. He is represented in this case by the attorneys of Wendler & Zinzilieta, P.C. in Maryville.
