EDWARDSVILLE – A contractor filed a negligence lawsuit against developers, claiming safety equipment was improperly installed on a work site and caused him to fall off a roof.
Plaintiff John Lamacchia filed the lawsuit in the Madison County Circuit Court against Russell Hallemann, Todd Skogley, J. Patrick McNamara, and Cleary Buidling Corp., citing negligence.
According to the lawsuit, prior to Dec. 31, 2021, McNamara entered into a contract with Cleary to construct a pole building on his property. Cleary subcontracted part of the construction to Skogley. The plaintiff alleges that either Cleary or Skogley further subcontracted work to Hallemann. According to the plaintiff, he was hired by Hallemann to do exterior work on the project, including constructing and installing the sheet metal roofing.
Lamacchia states that in December 2021, he was on the development site to work on the roof when he fell from the roof to the concrete surface below. Lamacchia alleges that he fell as a result of improperly installed roof purlins, which deprived him of safe and suitable fall protection. He adds that the work site lacked a proper safety system to suspend his fall, lacked solid support structure to support his weight, and lacked other equipment to carry out his duties safely.
Lamacchia claims he has sustained severe and extensive injuries, which have caused him to experience disability, pain and suffering. He claims his injuries will impact his ability to earn income and enjoy normal daily life. He adds that he has incurred medical expenses and will continue to require the services of medical staff to recover from his injuries.
The plaintiff is seeking damages in excess of $50,000, plus court costs, interest and any other relief the court deems proper. He is represented in this case by attorney Ryan D. Rich of Wham & Wham Lawyers in Centralia.
