Suit alleges soda display fell on customer at East St. Louis Walgreens

BELLEVILLE – A customer at an East. St. Louis Walgreens has filed a negligence lawsuit after a soda display allegedly collapsed and fell on him. 

Plaintiff Robert C. Luster, Jr. filed the lawsuit in the St. Clair County Circuit Court against Walgreens Co., Walgreens Boots Alliance, Inc., Bond Drug Company of Illinois, doing business as Walgreens, and Walgreen Eastern, Co., Inc., citing negligence.

According to the lawsuit, Luster was a patron at a Walgreens drug and retail store in East St. Louis on May 18, 2021. He claims he approached a display of soda that was stacked unreasonably high. He alleges that when he picked up a 12-pack of soda, the display collapsed and fell on him, causing him to suffer severe and permanent injuries. 

According to Luster, the defendants negligently failed to properly maintain the premises to protect the safety of its customers and created a hazardous condition in the store by stacking the packages of soda too high. 

Luster alleges he suffered severe and permanent bodily injuries, which have caused him to experience pain, suffering, mental anguish and disfigurement. He claims his injuries will impact his ability to earn income and lead a normal life. He adds that he has incurred medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Zachary W. Tobin of Pratt & Tobin, P.C. in East Alton.
