Breach of contract suit alleges insurer refuses to cover claim following fatal crash

BELLEVILLE – A woman's estate has filed a breach of contract lawsuit against her employer's insurance company for damages after she was killed in a car crash. 

Plaintiff Joshua Cumer, acting as administrator of the estate of Robin D. Cumer, filed the lawsuit in the St. Clair County Circuit Court against National Union Fire Insurance and Gallagher Bassett Services, Inc, citing breach of contract. 

According to the lawsuit, Robin Cumer was an employee at O'Reilly Auto Parts and was insured by the defendants through her employment. On Oct. 20, 2022 , the insurance policy was in full effect. Robin was operating a motor vehicle under the scope of her employment when she was allegedly struck and killed by an uninsured motorist.

The lawsuit states the loss was reported to the defendants, but they allegedly breached their contract and refused to pay damages as required under the terms of the policy. 

Joshua Cumer is seeking damages in excess of $50,000, plus attorney fees, interest and any other relief the court deems proper. He is represented in this case by attorney Samantha S. Unsell of Keefe, Keefe & Unsell, P.C. in Belleville.
