EDWARDSVILLE – Owners of an Edwardsville property have filed a breach of contract lawsuit against State Farm, alleging the insurer refuses to honor an insurance claim.
Plaintiffs Mark and Kristi Hofferber filed the lawsuit in the Madison County Circuit Court against State Farm Fire & Casualty, Co., citing breach of contract.
According to the lawsuit, the plaintiffs had entered into an agreement with State Farm Fire & Casualty, Co. to insure a property located in Edwardsville. The plaintiffs allege that on April 23, 2022, they discovered that the insured property had suffered considerable vandalism and water damage. They reported a claim for damages to the defendant.
The plaintiffs allege the defendant denied the claim and breached the agreement by failing to cover and pay for the insured damages, failing to provide reasonable claim adjustment services and failing to timely investigate the plaintiffs' claim.
The plaintiffs allege they have expended considerable amounts of money to repair the damages to the property and also in their attempts to persuade the defendant to uphold their end of the agreement and cover the damages.
The plaintiffs are seeking damages in excess of $50,000 plus court costs, interest and any other relief the court deems proper. They are represented in this case by the attorneys of Wendler and Zinzilieta, P.C. in Maryville.
