Lawsuit alleges Alton company terminated employee for filing worker's compensation claim

EDWARDSVILLE – A former employee of Hatch & Kirk in Alton claims he was fired in retaliation for seeking worker's compensation benefits after suffering injuries on the job.

Plaintiff William Burton filed the lawsuit in the Madison County Circuit Court against Hatch & Kirk, Inc., citing retaliatory discharge. 

According to the lawsuit, Burton was formerly employed by Hatch & Kirk as a warehouse manager. Burton alleges that on Feb. 3, he was terminated for not performing his duties according to expectations. However, he claims he was fired for filing a worker's compensation claim after being previously injured on the job. 

Burton is seeking damages for lost income and benefits, humiliation, mental anguish, and losses incurred while seeking other employment in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by the attorneys of Wendler & Zinzilieta, P.C. in Maryville.
