BELLEVILLE – The family of a former Rosewood Care Center resident claims he died after falling several times and receiving negligent care for his injuries.
Plaintiff Rosalie Nation, acting as independent executor of the estate of Robert Nations, filed a wrongful death lawsuit in the St. Clair County Circuit Court against Mercy Rehab and Care Center, doing business as Rosewood Care Center, citing negligence in violation of the state's Nursing Home Care Act.
According to the lawsuit, Robert Nations was a patient and resident admitted to the care of Rosewood Care Center in Swansea on May 3, 2022. The lawsuit alleges that while under the defendants' care, the decedent sustained injuries from several falls. He allegedly experienced cuts and lacerations that went untreated and severe bleeding in his head, all of which contributed to his death on Dec. 21, 2022, the suit states.
The lawsuit alleges that the the defendants neglected Robert and failed to provide him with proper care.
The lawsuit alleges that as Robert was admitted into the defendants' care, he was a protected individual under the state's Nursing Home Act. The suit states that Robert experienced physical and emotional trauma, disability, disfigurement, pain and suffering, expenses for medical care and ultimately died as a result of the defendants' negligence and carelessness.
Rosalie alleges that Robert's next of kin have been permanently deprived of his companionship and that as a result, they have suffered grief and sorrow. She also alleges they have incurred hospital, medical, funeral and other related expenses.
The plaintiff is seeking damages in excess of $50,000, plus court costs, attorney fees and any other relief the court deems proper. She is represented in this case by attorney Grey Chatham, Jr. of Chatham and Baricevic in Belleville.
