Twin Lake Trucking claims improperly loaded container caused truck to overturn

BELLEVILLE – Twin Lake Trucking filed a lawsuit to seek damages for one of its drivers that was allegedly in a collision because of an improperly loaded cargo container.

Plaintiff Twin Lake Trucking, LTD, on behalf of employee Rudolph Crockett, filed the lawsuit in the St. Clair County Circuit Court against Domtar Industries LLC and its subsidiaries, citing negligence.

According to the lawsuit, on March 24, 2021, Twin Lake Trucking employee Rudolph Crockett was acting under the scope of his employment and working as a driver to deliver freight. The lawsuit states that Twin Lake Trucking had a request by the defendant to transport a container, which was filled with rolls of paper. 

The lawsuit alleges the container that was loaded onto the truck was filled with heavy rolls of paper that were improperly braced to prevent them from shifting during transport. According to the plaintiff, while Crockett was transporting the container, the rolls of paper shifted and caused Crockett's truck to overturn. 

The lawsuit states that as a result of the defendant's negligence, Crockett sustained injuries that have caused him to experience pain and suffering. He claims his injuries will affect his ability to work for the company and enjoy a normal life. 

The lawsuit states that Crockett has incurred medical expenses and will continue to require the services of medical staff to recover. 

Twin Lake Trucking states that it has paid worker's compensation benefits to Crockett following the accident. 

The plaintiff is demanding a jury trial to seek damages in excess of $50,000, plus court costs and any other relief the court deems proper. They are represented in this case by the attorneys of James Kelly Law Firm, P.C. in Peoria.
