Homeowners allege concrete company failed to complete project

EDWARDSVILLE – A couple has filed a breach of contract lawsuit against Concrete Art, claiming the company didn't make good on a contract to complete work on their pool deck. 

Plaintiffs Benjamin E. Martin and Stephanie A. Martin filed the lawsuit in the Madison County Circuit Court against defendants Concrete Art, LLC, Gerald M. Vondebur and Dave Barrow, citing breach of contract and fraud. 

According to the lawsuit, on May 27, 2022, the plaintiffs entered into an agreement with the defendants to replace the concrete deck surrounding their pool. They claim they provided a deposit check of $9,350. 

The plaintiffs allege the defendants breached the contract by failing to replace the concrete deck. They also claim the misuse of equipment damaged the pool and left it unusable. They allege the defendants haven't returned the deposit check despite not providing the agreed upon services. 

The plaintiffs are seeking damages in excess of $50,000, plus interest, attorneys' fees, court costs and any other relief the court deems proper. They are represented in this case by attorney Lisa A. Behme of Bruckert, Behme & Long, P.C. in New Baden.
