Suit alleges guest died at Troy residence after homeowners failed to call 911

EDWARDSVILLE – A negligence lawsuit alleges a woman died as a guest at a Troy home when no one called for emergency medical services after she became severely ill.

Plaintiff Kathy Munoz, mother and acting as independent administrator of the estate of Mikayla Leveling, filed the lawsuit in the Madison County Circuit Court against defendants David J. Mann and Kimberly A. Barrios, citing negligence.

According to the lawsuit, Mikayla was a visitor at the defendants' home in Troy on Aug. 24, 2022. While she was there, she allegedly became severely ill and required medical assistance. 

The lawsuit states that the defendants had a duty to provide ordinary and reasonable aid and protect Leveling while she was under their care. The defendants negligently failed to provide or arrange for appropriate medical care or contact emergency services when it was apparent that she was in need of medical assistance. According to the lawsuit, as a result of the defendants' negligence, Leveling tragically died.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorney Steven Giacoletto of the Giacoletto Law Firm in Collinsville.
