Missouri attorney sued for legal malpractice over dismissed Illinois car crash suit

EDWARDSVILLE – A man filed a legal malpractice suit against his former attorney for allegedly taking on a personal injury case for a state in which he was not licensed to work and failing to serve notice within a reasonable time after filing the original lawsuit

Plaintiff Charles Kurtzeborn filed the lawsuit in the Madison County Circuit Court against defendant Martin Jansky, citing negligence.

According to the lawsuit, Jansky is an attorney licensed to work in Missouri. Kurtzeborn claims he was involved in a car crash on Feb. 11, 2015, and hired the defendant to represent him as his attorney for a personal injury claim arising from the collision.

The lawsuit states that at the time Kurtzeborn hired Jansky to be his attorney and throughout he representation, Janksy never had a license to practice law in the state of Illinois. He also claims Jansky failed to serve notice of the personal injury claim within the state's two year statute of limitations. 

As a result of the defendant's alleged negligence, the plaintiff was unable to file his personal injury claim within the statute of limitations and his case was dismissed.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Jarrod P. Beasley of Kuehn, Beasly & Young, P.C. in Belleville.
