EDWARDSVILLE – A shopper is suing Walmart after he allegedly slipped and fell on ice that had formed in a pothole in the Collinsville store's parking lot.
Plaintiff Denny Doty filed the lawsuit in the Madison County Circuit Court against Wal-Mart Inc., citing negligence.
According to the lawsuit, Doty was a patron at a Walmart store in Collinsville on Feb. 14, 2022. Doty claims he parked his vehicle in a handicapped parking spot in the store's parking lot. He alleges that while he was exiting his vehicle, he slipped and fell on an accumulation of ice that had formed in a pothole.
According to Doty, the defendants negligently failed to properly maintain the premises to protect the safety of its customers.
Doty alleges he suffered bodily injuries, which have caused him to experience disability, pain and suffering. He claims his injuries have impacted his ability to enjoy a normal life. He adds that he has incurred medical expenses and will continue to require the services of medical staff to recover.
The plaintiff is seeking damages in excess of $75,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Jeffrey A. Kopis of Jerome, Salmi and Kopis, LLC in Fairview Heights.
