Watco Transloading employee alleges injuries from rail car derailment

EDWARDSVILLE – A Watco Transloading employee claims he was injured when railroad cars derailed. 

Plaintiff Michael Deleonypena filed the lawsuit in the Madison County Circuit Court against Watco Companies, LLC, doing business as Watco Transloading, LLC.

According to the lawsuit, Deleonypena was an employee for the defendants and worked as a switchman. On March 10, 2022, Deleonypena was bringing in railroad cars into the defendant's facility when the cars derailed. The incident allegedly caused him to be flung off the car he was riding on and fall to the ground, causing him to suffer injuries.

The plaintiff alleges the defendants negligently failed to provide him with a reasonable place to work.

Deleonypena alleges he suffered injuries that aggravated a pre-existing condition, which caused him to experience pain, suffering, loss of wages and benefits. He alleges his injuries will impact his ability to enjoy normal life. He adds that he has incurred medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus interest, court costs and any other relief the court deems proper. He is represented in this case by attorney Patrick O'Brien of the Law Offices of Patrick S. O'Brien in St. Louis.
