Breach of contract suit filed against Allen Insurance Group

EDWARDSVILLE – Following a burst water pipe, a property owner has filed for damages alleging an insurance broker never bought insurance for the property despite being paid to do so. 

Plaintiffs Real Estate Direct, LLC and Stanley Obrecht, Jr., filed the lawsuit in the Madison County Circuit Court against the Allen Insurance Group, LLC and NBS Insurance Agency, Inc. citing negligent misrepresentation and breach of contract.

According to the lawsuit, the plaintiffs owned a property located in Edwardsville. They allege that on June 1, 2022, they completed an application with the defendants, which acted as an insurance broker, to insure the property against fire, flood and casualty loss.

The lawsuit states that in December 2022, the plaintiff's property suffered from a burst water pipe. The incident allegedly caused significant damage to the property. The defendants allegedly communicated falsely to the plaintiffs that the damage would be covered under the plaintiff's insurance policy. 

The plaintiffs allege the defendants never actually procured insurance for the plaintiffs, which would have included coverage for water damage despite regular payments from the plaintiff.

The plaintiffs are seeking damages in excess of $50,000 and any other relief the court deems proper. They are represented in this case by the attorneys of Wendler and Zinzilieta, P.C. in Maryville.
