Man alleges brain injury when medical scooter fell on him during transport

BELLEVILLE – A passenger is suing Alternative Transportation Systems, claiming he was seriously injured when his medical scooter flipped and fell on him while traveling to a dialysis appointment.

Plaintiff Julius Walker filed the lawsuit in the St. Clair County Circuit Court against Alternative Transportation Systems, Inc and an ATS employee, citing negligence. 

According to the lawsuit, on Feb. 3, 2023, Walker was being transported to a dialysis appointment by Alternative Transportation Systems (ATS) and his medical scooter was secured to the floor of the ATS vehicle by an ATS employee. Walker alleges that as the vehicle made way to his appointment, it crossed a set of railroad tracks, knocking his scooter loose and causing it to pin him to the floor of the van. 

The lawsuit alleges the defendants negligently failed to properly secure his scooter to the ATS van, failed to operate the vehicle in a safe manner, and failed to operate the vehicle at a proper speed. 

Walker claims he has sustained severe and permanently disabling injuries, including a brain injury, which have caused him to experience pain, suffering and mental anguish. He alleges his injuries will affect his ability to enjoy normal activities and earn income in the future. He also claims he has incurred medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Bruce R. Cook of Cook, Bartholomew, Shevlin, Cook & Jones, LLP in Belleville.
