BENTON – Joe Hand Promotions, which licenses broadcast rights for boxing matches, moved for default judgment on March 8 on a claim that Da Beno bar in East St. Louis showed matches without licenses.
Joe Hand counsel Yeoeun Yoon of Chicago asked U. S. District Judge Staci Yandle to award $12,500 for each of six violations that occurred in 2019.
Yoon claimed Joe Hand could request $110,000 for each violation.
Yoon also sought $6,720 as the amount Da Beno should have paid for licenses, $1,500 for his fee, and $1,234.64 for costs, for a total of $84,454.64.
Joe Hand sued Da Beno and owner Ebony Jones in November.
Jones didn’t answer and Joe Hand moved for entry of default in January.
The clerk entered default, and Jones still didn’t answer.
Yoon stated in his motion for judgment that Joe Hand’s allegations were deemed admitted.
He stated that an auditor visited Da Beno and observed about 80 patrons watching a match.
Yoon stated it would be impossible to determine the full extent of lost profits.
He stated interception of programs threatens the viability of the closed circuit industry.
He added that defendants broadcast the events for free and enjoy the proceeds without paying a financial investment.
He stated advertising the events on Facebook demonstrated willfulness and intent to profit.
