BELLEVILLE – An Illinois woman filed a class action lawsuit against ALDI, claiming the company purposely misrepresents the amount of servings in its brand of oatmeal.
Plaintiff Tiffany Hassard filed the class action lawsuit in the St. Clair County Circuit Court against ALDI Inc., citing fraud, negligent misrepresentation, and breach of express warranty in violations of the Illinois Consumer Fraud Act (ICFA).
The lawsuit alleges that Aldi sells it's brand of oatmeal labeled as 42 oz. and containing "about 30 half-cup servings" in the container. However, Hassard alleges preliminary tests show that the actual number of half-cup servings in the container is closer to 26.
The plaintiff claims ALDI substantially over-reports the actual number of servings in its oatmeal, overcharges the consumer and pockets the difference. The lawsuit states that ALDI sells millions of pounds of oatmeal every year, so the amount of collective damages totals millions of dollars annually.
Hassard is seeking damages for herself and everyone in her class action lawsuit plus court costs, attorney fees and any other relief the court deems proper. She is also seeking injunctive action to order ALDI to cease from further misrepresentation of its product.
