BELLEVILLE – A driver claims that American Family Mutual Insurance Company has refused to honor her insurance policy claim after she was rear ended by an uninsured motorist.
Plaintiff Suzanne K. Alt filed the lawsuit in the St. Clair County Circuit Court against Adreien K. Modglin and American Family Mutual Insurance Company, citing negligence and breach of contract.
According to the lawsuit, on Nov. 21, 2021, Alt was driving when she was allegedly rear-ended by Modglin, who was driving too closely to her vehicle. Modglin was reportedly an uninsured motorist and allegedly fled the scene of the collision.
Alt claims Modglin failed to drive her vehicle in a proper manner to avoid a collision and improperly left the scene of the crash.
Alt clams that as a result of the collision, she has sustained severe and permanent injuries that have caused her to experience pain, suffering, mental anguish and lost wages that will impact her ability to enjoy daily life and earn income in the future. She adds that she has incurred medical expenses and will require medical care to recover from her injuries.
Alt is seeking damages from Modglin for an amount exceeding $1,000,000, plus court costs and any other relief the court deems proper.
The lawsuit states that at the time of the collision, Alt had an insurance policy with American Family Mutual Insurance Company for her vehicle that included underinsured motorist coverage in the amount of $1,000,000 to cover bodily injury. The lawsuit states that the plaintiff suffered bodily injuries and that American Family was required to pay all compensatory damages from the owner of an underinsured motor vehicle. She alleges the insurer has denied her any payments.
Alt is seeking damages from American Family for an amount exceeding $1,000,000, plus attorneys fees, court costs and any other relief the court deems proper.
