Suit alleges delivery driver caused crash on Highway 15

BELLEVILLE – A family is suing FedEx after a contracted driver allegedly caused a collision on Illinois Highway 15. 

Plaintiffs Laura Wegrzyn and Walter Wegrzyn filed the lawsuit in the St. Clair County Circuit Court individually and as parents of Shelby Wegrzyn, a disabled adult, against FedEx Corporation, Kabaj Corporation and Dallas B. Cook, citing negligence.

According to the lawsuit, Cook was an employee of Kabaj, a company contracted by FedEx to deliver parcels on its behalf. The lawsuit states that on Dec. 26, 2011, Cook was acting under the scope of his employment and driving a FedEx delivery truck when he got into a collision with the plaintiffs. Cook allegedly crossed the center line on Illinois Highway 15 and attempted to make a left turn in front of the plaintiffs' oncoming vehicle, which caused a collision. 

The lawsuit states that prior to the collision, Cook had a record of prior citations and convictions for numerous driving violations, including failing to yield while making a left turn. Additionally at the time of the collision, Kabaj was not authorized by the U.S. Department of Transportation to operate as an interstate, for-hire carrier, according to the lawsuit.  

The plaintiffs claim that as a result of the collision, they have experienced severe and disabling injuries, which will require medical treatment and impact their ability to enjoy daily life and earn income. Laura Wergrzyn claims her injuries are permanent and that she will lose a substantial amount of income.

The plaintiffs are seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. They are represented in this case by the attorneys of Mathis, Marifan & Richter, LTD in Belleville.
