Woman allegedly bit by dog at friend's house, files negligence suit

BELLEVILLE – A woman claims she was visiting a friend when a dog attacked her unprovoked, causing her to suffer injuries. 

Plaintiff Emma Harris filed the lawsuit in the St. Clair County Circuit Court against Elizabeth L. Tygart f/k/a Elizabeth L. Cochenour, citing negligence in violation of the Illinois Animal Control Act.

According to the lawsuit, the plaintiff, who was a minor at the time, was visiting the defendant's home on Dec. 26, 2011. While there, she claims the defendant's dog suddenly and without provocation attacked her. The lawsuit states that the dog bit Harris above her right eye and on the lips. 

Harris alleges that prior to the incident, the dog had attacked and bit another child.

Harris claims she sustained severe and permanent injuries, which have caused her to experience pain, suffering, mental anguish, disfigurement and disability. She alleges her injuries will affect her ability to enjoy normal activities and earn income in the future. The lawsuit states that Harris has incurred medical expenses and will continue to require the services of medical staff to recover. 

Harris alleges that under the Illinois Control Act, the owner of a dog is liable for injuries caused by the animal.

The plaintiff is seeking damages in excess of $50,000, plus court costs. She is represented in this case by attorney Matthew J. Marlen in Belleville.
