Woman sues O'Fallon American Legion over trip, fall

BELLEVILLE — A woman claims she tripped and injured herself on the sidewalk at the O'Fallon American Legion facility while construction was underway. 

Plaintiff Ginger Zehner filed a complaint in the St. Clair County Circuit Court against Fisher-Solis Post 137 O'Fallon American Legion and ATK Services, Inc., alleging negligence. 

According to her complaint, Zehner was at a facility owned by the O'Fallon American Legion on April 16, 2021. She claims construction was going on at the premises, which caused the sidewalk to become in a state of disrepair. Zehner alleges she was using the sidewalk near the entry of the facility in the evening when she tripped and severely injured herself.

Zehner alleges the defendants negligently failed to supervise repairs to the sidewalk, failed to provide a safe entry/exit for its guests, failed to provide warning of the dangerous state of the sidewalk, and failed to provide proper lighting showing the sidewalk was in disrepair.

The plaintiff claims that as a result of her fall, she suffered an injury to her hip. She alleges her injury caused her to experience pain, suffering, mental anguish, disability and lost wages. She adds that she has incurred medical treatment costs and will require medical services to recover from her injuries.

Thurman seeks compensation in excess of $50,000, plus court costs. She is represented attorneys Eric M. Rhein and Grey Chatham in Belleville.
