Telemarketing companies sued for allegedly selling unsolicited automobile warranties over the phone

EDWARDSVILLE – An Illinois woman filed a class action lawsuit against telemarketing companies for allegedly selling her an unsolicited automobile extended warranty over the phone.

Plaintiff Angelina Showers filed a class action lawsuit in the Madison County Circuit Court against Pelican Investment Holdings Group, LLC, doing business as AAP Auto Service Department, Dimension Service Corporation, and SING For Service, LLC doing business as Mepco, LLC, alleging violations of the Telephone Consumer Protection Act (TCPA) and the Illinois Telephone Solicitations Act (ITSA).

According to the lawsuit, the plaintiff received unsolicited phone calls from the defendants attempting to sell her vehicle service contracts marketed as automobile extended warranties. She was also solicited to pay money, which she did, over with phone without written consent. Showers states that her phone number has been included on the National Do Not Call Registry since Jan. 12, 2006.

According to the lawsuit, the Telephone Consumer Protection Act (TCPA) states that no entity shall initiate a telephone solicitation to anyone that has registered their phone number on the National Do Not Call Registry and that telephone solicitors must maintain a list of persons who request not to receive telemarketing calls. The lawsuit alleges that the defendants regularly make phone calls to individuals on the National Do Not Call Registry in violation of the TCPA. Furthermore the Illinois Telephone Solicitations Act (ITSA) requires that telephone solicitors must state their name, the name of their business and the purpose of the call as well as obtaining consent from the person called whether they consent to solicitation, actions the defendants regularly failed to take.

The plaintiff is seeking statutory damages for each violation for each person covered by the class action lawsuit along with attorney fees, court costs and any other relief the court deems proper. She is also seeking injunctive action to order the defendants to cease from further illegal actions. She is represented by attorneys Leigh M.
