EDWARDSVILLE – River Crossing of Edwardsville has been named in a wrongful death lawsuit alleging negligence contributed to the death of a resident.
Plaintiff Rosemary Mackin, acting as independent executor of the estate of Pamela S. Broska, filed a wrongful death lawsuit in the Madison County Circuit Court against Edwardsville NH, LLC doing business as River Crossing of Edwardsville and Care Center at Center Grove, NH Operator Holdings, VII, LLC, and two caretakers, citing gross negligence and reckless conduct in violation of the Illinois Nursing Home Act.
According to the lawsuit, Broska was admitted as a resident to River Crossing of Edwardsville on Jan 15, 2021. Upon admission, Broska was alert and coherent. She was assessed as a moderate risk for skin breakdown and a risk for suffering falls. The lawsuit states that despite the assessment, Broska developed a skin condition on her buttocks on Jan. 18. Then on Jan. 19, she fell and struck her head on a doorway. Despite these incidents, no nursing notes or assessments were documented following the incidents, Mackin alleges.
On Jan. 22, Broska was documented as having a pressure ulcer. Then on Jan. 23, she suffered another fall and had to be transported to a hospital. Broska died of her injuries on Jan. 31, 2021.
According to the lawsuit, Broska died as a result of the defendants' negligence and carelessness. The lawsuit states that the defendants violated the state's Nursing Home Care Act by negligently failing to provide sufficient care. The suit states that staff failed to safely meet Broska's specific personal needs. The plaintiff alleges that defendants'' negligence caused Broska to needlessly endure pain and suffering until her death.
The plaintiff is seeking damages in excess of $50,000, plus attorney fees and any other relief the court deems proper. She is represented in this case by attorney Jaye R. Lindsay of Crossroad Legal, LLC in Edwardsville.
