Shopper sues Highland Walmart over alleged trip, fall

EDWARDSVILLE – A shopper is suing a Highland Walmart after she allegedly tripped on an undetectable pallet and suffered injuries. 

Plaintiff Patricia M. Hultz filed the lawsuit in the Madison County Circuit Court against Wal-Mart Inc., citing negligence.

According to the lawsuit, Hultz was a patron at a Walmart Supercenter store in Highland on Nov. 18, 2021. She claims that while she was shopping, she tripped on the edge of a pallet. She alleges the pallet was placed in a manner where it was covered by boxes and crates of produce, causing it to be nearly undetectable. 

According to Hultz, the defendants negligently failed to properly maintain the premises in an orderly fashion to protect the safety of its customers.

Hultz alleges she suffered severe bodily injuries, which has aggravated a pre-existing condition and has caused her to experience pain, suffering, mental anguish, and disfigurement. She adds that the injuries will impact her ability to earn income and lead a normal life. Hultz claims she has incurred medical expenses and will continue to require the services of medical staff to recover.

The plaintiff is demanding a jury trial to seek damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorney Fritz G. Faerber of Faerber & Anderson, P.C. in Kirkwood.
