EDWARDSVILLE – A homeowner filed a breach of contract lawsuit against R & R First Choice Roofing for allegedly failing to prepare a proper contract and for allegedly botching the roof repairs.
Plaintiff Kimberly Adams filed the lawsuit in the Madison County Circuit Court against business owner Ronnie Wiggins and R & R First Choice Roofing, citing breach of contract in violation of the Home Repair and Remodeling Act
According to the lawsuit, on Sept. 1, 2021, the plaintiff's home was experiencing issues with a leaking roof. Adams contacted the defendants to provide roof repair services. The defendants allegedly entered into an agreement to repair the roof for $14,448.00, but no contract was written up.
Adams alleges that despite the agreement, the defendants failed to repair the room in a professional and timely manner and left it in a state of disrepair. She alleges that she incurred additional costs, because she had to hire other contractors to repair the unfinished and unworkmanlike repairs of the defendants.
The lawsuit states that the Home Repair and Remodeling Act requires a written contract to be furnished to the home owner for home repairs totaling $1,000 or more. Adams claims the defendants violated the Act by not providing a written contract for the work prior to initiating repairs.
The plaintiff is seeking damages in excess of $50,000, plus court costs, attorney fees, interest and any other relief the court deems proper. She is represented in this case by the attorneys of Wendler & Zinzilieta, P.C. in Maryville.
