EDWARDSVILLE – A former Sam's Club employee claims she was fired for seeking worker's compensation benefits after she was injured on the job.
Plaintiff Magdalena P. Szetlak filed the lawsuit in the Madison County Circuit Court against Sam's Club, citing wrongful termination in violation of the Illinois Worker's Compensation Act.
According to the lawsuit, Szetlak was an employee of a Sam's Club in Glen Carbon. Szetlak claims that on Feb. 7, 2022, she sustained injuries on the job. She allegedly notified Sam's Club of her injury and her intention to seek worker's compensation benefits. Szetlak claims that on May 6, 2022, she was terminated from her position in retaliation for seeking worker's compensation benefits and exercising her rights under the the Illinois Worker's Compensation Act.
Szetlak claims she suffered humiliation, mental anguish, and loss of wages and benefits. She adds that Sam's Club's actions will impact her ability to secure employment in the future.
The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. She is represented in this case by attorney Keith Short of Keith Short and Associates, P.C. in Alton.
