Belleville credit union alleges flood damages from malfunctioning sump pump

BELLEVILLE – A business in Belleville alleges it has suffered more than $75,000 in damages after a malfunctioning sump pump failed to operate during a flood. 

Plaintiff Starnet Insurance Company, a/s/o Scott Credit Union, filed a lawsuit in the St. Clair County Circuit Court against Zeller Technologies, Inc. and France Mechanical Corporation, citing negligence. 

According to the lawsuit, Scott Credit Union is a business holding an insurance policy with Starnet Insurance Company, which included coverage for water damage. In the spring of 2019, Scott Credit Union had a sump pump designed by Zeller Technologies installed in its facility by France Mechanical Corporation.  

Starnet alleges that since the sump pump was installed, the system has experienced numerous issues that had to be corrected by France and Zeller. The plaintiff alleges that despite these corrections, the sump pump malfunctioned and failed to turn on during a flood on Aug. 25, 2019.  As a result of the flood, Scott Credit Union's facility and it's property allegedly suffered damages that cost $77,575.15. The plaintiff claims the damages were covered under its insurance policy.  

The plaintiff adds that the defendants negligently installed a sump pump that was improperly designed and that it failed to operate during a flood.

Starnet is seeking damages in the amount of $77,575.15, plus court costs and any other relief the court deems proper. They are represented in this case by attorney Brian T. Bailey of Nielsen, Zehe & Antas, P.C. in Chicago.
